Clarifies that school districts are not required to provide education services to students who are not Minnesota residents, do not have an individual education plan, or do not have a tuition arrangement with the placing authority.

Requires the commissioner to approve education programs in residential facilities licensed by the Department of Human Services or Department of Corrections before licensure, with programs conforming to state and federal education laws including IDEA.

Mandates that the district where a residential facility is located must provide education services, including special education if eligible, to all students placed in that facility.

Establishes that education services must begin within three business days of a student entering a care and treatment facility, with the first four days used for screening educational and safety issues.

Effective July 1, 2010, for fiscal years 2011 and later.
