No health insurance rate increase over 8 percent may be approved by the commissioner of commerce until a public hearing is held in accordance with chapter 14, with the hearing location accounting for the geographical distribution of affected customers.

Health carriers sponsoring affected health plans must notify all enrolled plan members of the hearing date, time, and location once the hearing is scheduled.

The commissioner or designee and a health carrier executive must be available to provide testimony at the public hearing.

Health carriers must pay all expenses reasonably attributable to the public hearing, with the commissioner determining the amount and billing the carrier, who must pay the state within 30 days of presentation.

Health carriers may file objections to a bill within 30 days of presentment, with the commissioner holding a hearing on objections within 60 days in accordance with chapter 14.

This requirement applies to rate increases effective on or after January 1, 2011.
