• Redistricting plans for legislative seats and political subdivisions cannot be adopted until the U.S. Bureau of the Census publishes population counts by correctional facility from the decennial federal census.

• The Legislative Coordinating Commission must remove incarcerated persons from census block populations where state or federal correctional facilities are located and post revised counts on its website within seven days of Census Bureau publication.

• Revised population counts excluding incarcerated persons must be used by the legislature when drawing legislative districts and by political subdivisions when drawing city wards and other local government election districts.

• The act becomes effective January 1, 2011, and applies to redistricting plans based on the 2010 federal decennial census and subsequent censuses.
