HF 3567 Summary

• Broadens the definition of "BB gun" to include realistic appearing airsoft guns that resemble pistols, rifles, shotguns, and other firearms designed to fire less-lethal plastic projectiles weighing 10.0 grains or less, unless permanently colored bright yellow, blaze orange, neon green, or bright pink on 80 percent or more of surface area visible in daylight.

• Prohibits possession, storage, or use of dangerous weapons, replica firearms, or BB guns on school property, with penalties of up to two years imprisonment or $5,000 fine for knowing violations; possession of replica firearms or BB guns on school property is a gross misdemeanor.

• Exempts from the prohibition: active peace officers, military personnel on duty, authorized permit holders, firearm safety courses, ceremonial color guards, gun shows, persons with written principal permission, and individuals on unimproved school property unaware of student presence for school-related activities.

• Prohibits threatening display or exhibition of replica firearms or BB guns in a manner causing terror or reckless disregard for risk of terror, with penalties up to one year imprisonment or $3,000 fine.

• Effective August 1, 2010, and applies to firearm incidents occurring on or after that date.
