Commissioner of transportation shall publish a bid-letting schedule on the department's website for anticipated trunk highway construction, reconstruction, and maintenance projects for the ensuing 12 months, including anticipated letting date, project summary information, estimated funds, and disadvantaged business enterprise participation goal.

Commissioner shall only accept bids from contractors who have been issued a valid certificate of compliance as provided under section 363A.36.

Contractor shall submit a workforce plan for each federally-funded trunk highway project identifying strategies to meet the disadvantaged business enterprise participation goal and providing employment projections for women and minorities, with a deadline set by the commissioner.

Commissioner shall establish a compliance review process by January 1, 2011 to monitor contractor compliance with good faith efforts to meet disadvantaged business enterprise goals, including criteria for noncompliance and referral procedures to the commissioner of human rights.

Commissioner shall publish employment and earnings data by trade level, race, and gender for disadvantaged business enterprises on trunk highway projects, and report biennially to legislature on overall goals achieved, methodology, good faith efforts, and contractor sanctions.
