• Authorizes health plan companies to offer flexible benefits plans that may modify or exclude coverage requirements except for maternity benefits and federal requirements, subject to commissioner approval.

• Requires health plans to provide purchasers with a written list prior to sale describing all coverages that are modified or excluded, with explanations of modifications.

• Establishes primary care provider tiering system where the commissioner adjusts rates annually based on enrollee numbers and peer provider payments, with providers exceeding one standard deviation above mean annual cost per patient subject to 30 percent payment withhold.

• Authorizes enrollee incentives for choosing high-performing primary care providers, to be implemented within 120 days of federal approval, including enrollee credits for prescription drug co-pays.

• Repeals Minnesota Statutes 2008, section 62L.056 effective January 1, 2012, with flexible benefits plan provisions effective January 1, 2012, and primary care tiering provisions effective for calendar year 2010 and thereafter.
