Public entities and commercial building owners must ensure facilities collecting mixed municipal solid waste have containers for at least three recyclable materials, including paper, glass, plastic, and metal.

All recyclable materials collected must be transferred to a recycler.

"Commercial building" is defined as a building containing a business classified in sectors 42 to 81 under the North American Industrial Classification System that contracts for 16 cubic yards or more per week of solid waste collection.

"Public entity" includes the state, state offices and agencies, the Metropolitan Council, the legislature, courts, counties, cities, towns, school districts, special taxing districts, and entities receiving state capital improvement appropriations after August 1, 2002.

The section becomes effective January 1, 2011.
