• Authorizes the transportation commissioner to use indefinite delivery/indefinite quantity contracts for construction projects not exceeding $1,000,000 in cost, with competitive bidding requirements and separate technical and price proposals.

• Establishes construction manager at risk contracting procedures including a two-phase process: Phase 1 solicits proposals evaluated by a technical review committee, and Phase 2 involves independent cost estimation and contract negotiation for a guaranteed maximum price.

• Limits construction manager at risk projects funded with state general obligation bonds to no more than two projects and restricts these entities from participating in design-build contracts subsequently advertised under sections 161.32 or 161.3410 to 161.3428.

• Requires the commissioner to notify legislative committees with transportation jurisdiction each time the construction manager at risk procurement method is selected and to explain why that method was chosen.

• Amends Minnesota Statutes section 161.3426 to establish stipulated fees of at least 0.2% of estimated design and construction costs paid to unsuccessful short-listed proposers who achieve minimum technical scores.
