Establish requirement for law enforcement agencies maintaining criminal gang investigative and evidence databases to adopt written policies governing collection, inclusion, access, use, dissemination, and safeguarding of data, effective October 1, 2010.

Require written policies to comply with Code of Federal Regulations, title 28, part 23 guidelines.

Define "criminal gang investigative and evidence database" as a computerized database maintained by law enforcement agencies for identifying gang members and investigating or prosecuting criminal gang activity.

Mandate annual certification by law enforcement agencies to a board confirming adoption of compliant written policy or that the agency does not maintain or administer a criminal gang investigative and evidence database.

Set effective date of July 1, 2010 for this section.
