HF 3814 Summary

• Modifies Minnesota Statutes 2008, section 216B.164, subdivisions 3 and 4, to include base-load facilities that generate electricity from anaerobic digester systems in regulations for qualifying facilities and small facilities.

• Allows qualifying facilities with less than 40-kilowatt capacity and base-load anaerobic digester facilities to elect compensation at the average retail utility energy rate instead of avoided costs, defined as the average retail energy rates excluding special rates based on income, age, or energy conservation.

• Permits utilities interconnected with nongenerating utilities under sole source contracts with municipal power agencies to treat net input purchases on behalf of their suppliers and be reimbursed for additional costs incurred.

• Requires utilities to provide wheeling or exchange agreements for facilities with 30-kilowatt capacity or more and base-load anaerobic digester facilities to sell output to other Minnesota utilities with anticipated generation expansion over the ensuing ten years.

• Takes effect August 1, 2010, and applies to electricity produced by base-load facilities generating electricity from anaerobic digester systems after January 1, 2011.
