HF3821 Summary

• Modifies the definition of "independent expenditure" to clarify that expenditures by a political party in a race where the party has a candidate on the ballot are not independent expenditures, effective upon final enactment.

• Requires entities making independent expenditures exceeding $5,000 for state office candidates or $5,000 for state constitutional amendments, or engaging in electioneering communications exceeding $25,000 in the aggregate, to file 48-hour reports with the board detailing the expenditure amount, date, purpose, and candidate or ballot question information.

• Prohibits principal campaign committees, political committees, political funds, and political party units from making deceptive solicitations that falsely state or imply contributions will not be used to support or oppose candidates or ballot questions, with violations subject to civil penalties up to $3,000.

• Requires corporations that make political contributions or expenditures to notify shareholders quarterly in writing of the nature and amount of such activity and provide copies to the campaign finance board for public posting on its website.

• Modifies campaign literature disclaimer requirements to specify exact forms for disclaimers on materials prepared by candidates, political committees, political funds, political party units, and other entities, effective June 1, 2010.
