School districts may not spend more than one percent of total annual operating expenditures on promotional materials, advertising, or other materials designed to encourage nonresident students to attend their schools.

Nonresident districts may transport pupils within the pupil's resident district only with approval from the resident district.

Parents or guardians may appeal a resident district's denial of transportation approval to the commissioner of education, who must rule within 60 days of receipt.

Amends Minnesota Statutes 2008, section 124D.03, by adding subdivision 13 on recruitment and pupil transportation.

Effective date is July 1, 2010.
