Health plan companies must establish equal out-of-pocket requirements (co-payments, deductibles, coinsurance) for orally administered anticancer medications and intravenously administered or injected chemotherapy medications.

Health plan companies cannot achieve compliance by increasing costs for intravenously administered chemotherapy; they must lower oral medication costs or keep them equal.

Health plan companies may still require prior authorization and other appropriate utilization controls for chemotherapy coverage.

Orally administered anticancer medications cannot be placed in the fourth tier of a health plan's pharmacy benefit to comply with this requirement.

Effective August 1, 2010, for health plans offered, issued, sold, renewed, or continued to Minnesota residents on or after that date.
