Expands the definition of "attorney" to include law clerks, investigators, paralegals, and dispositional advisors working for the attorney, in addition to private attorneys, public defenders, and public defense corporation attorneys.

Requires local correctional facilities to provide private telephone access to attorneys at no charge to either the attorney or person in custody, including calls to wireless cellular telephones.

Requires state correctional facilities to provide private telephone access to attorneys at no charge, including calls to wireless cellular telephones, in accordance with institutional policies meeting constitutional requirements.

Creates a misdemeanor penalty and $100 civil forfeiture to the aggrieved person for violations of consultation or telephone access requirements in subdivisions 1 and 2.

Exempts officers and persons in state correctional facilities from criminal penalties, applying penalties only to local correctional facility violations.
