Licensed peace officers may use firearm silencers for tactical emergency response operations (high-risk warrants, terrorism incidents, hostage rescue) and practice on approved shooting ranges, with law enforcement agencies required to establish written policies governing use.

Until July 1, 2011, enforcement officers, wildlife area managers, and Department of Natural Resources contractors may use silencers for wildlife control operations requiring stealth at locations authorized by the commissioner, limited to no more than ten devices with direct custody requirements.

Federally licensed firearms manufacturers' sales representatives who are not prohibited from possessing firearms may possess silencer samples solely for demonstrating devices at law enforcement agencies or approved shooting ranges for sale to licensed peace officers.

The Department of Natural Resources must establish and enforce a written policy governing use, possession, and transportation of silencing devices if the commissioner determines their use is necessary for wildlife control operations.

Effective date is August 1, 2010.
