Repeals Minnesota Statutes 2008, section 169.685, subdivision 4, which previously prohibited evidence of seat belt use or failure to use seat belts and child passenger restraint systems in civil litigation involving motor vehicle injuries or property damage.

Eliminates the general bar on admitting seat belt and child restraint system evidence in personal injury and property damage cases arising from motor vehicle operations.

Maintains an exception for actions involving defectively designed, manufactured, installed, or operating seat belts or child passenger restraint systems, where such evidence remains admissible.

Effective the day following final enactment and applies to civil actions commenced on or after that date.
