Municipalities must require a franchise or extension permit for any cable communications system providing service within their jurisdiction

Municipalities cannot grant additional cable franchises on more favorable or less burdensome terms than existing franchises regarding service area, public/educational/governmental access requirements, or franchise fees, unless the area is not currently being served

Telephone companies are exempt from the equal terms requirement if the additional franchise area covers at least the same geographic area where the telephone company offers local exchange service

Municipalities retain authority to impose additional terms and conditions on any new franchises beyond the requirements in this statute

Effective date is August 1, 2010, with no retroactive application to pending litigation
