The commissioner of transportation may enter into agreements with governmental, nongovernmental, private, and nonprofit entities to finance or invest in transportation projects, with repayment subject to availability of state money or dedicated revenue and approval of the Minnesota Management and Budget commissioner.

Beginning August 1, 2011, and annually thereafter, the commissioner must submit an electronic listing of all executed agreements to legislative committees with transportation jurisdiction and the Legislative Reference Library, identifying each agreement, contracting entities, contract amount, duration, and repayment requirements.

The commissioner may apply for and receive federal financial assistance under the Transportation Infrastructure Finance and Innovation Act of 1998 (TIFIA) and other federal transportation loan, grant, or credit assistance programs, including loans, loan guarantees, and lines of credit.

The commissioner may enter into repayment agreements for federal financial assistance subject to availability of state money or dedicated revenue or resources, with approval of the Minnesota Management and Budget commissioner.
