SF 2639 Summary

• Implements a moratorium on new child and adult foster care licenses where the license holder's primary residence is not at the physical service location, with exceptions for settings registered under Chapter 144D, replacements for existing licenses, closures of nursing facilities/ICF/MR/regional treatment centers, hospital-level care, and transitions from personal care assistance to home and community-based services.

• Requires adult foster care license holders to comply with HIPAA and Minnesota Government Data Practices Act; prohibits bathroom monitoring cameras; requires visible electronic monitoring; limits video/audio recording storage to five days unless related to abuse/neglect investigations; requires notice to recipients about monitoring practices.

• Establishes reporting requirements for monitoring compliance through a checklist developed by the commissioner; allows residential settings in the licensing process as of July 1, 2009 to complete licensure if five criteria are met and documentation is submitted by August 1, 2009; requires study of moratorium effects by January 15, 2011.

• Modifies Minnesota supplemental aid special needs provisions by extending the shelter needy housing benefit paragraph expiration date from June 30, 2011 to June 30, 2012 and clarifying eligibility for multifamily buildings of six or more units with a 50 percent unit occupancy cap.
