School boards may convert the number of instructional days adopted for the 1996-1997 school year to an equivalent number of instructional hours, provided they notify the commissioner.

Removes the requirement that flexible learning year programs must be "approved by the commissioner" and replaces it with a "notice to the commissioner" standard for establishing or terminating such programs.

Flexible learning year programs can utilize buildings and facilities during the entire year or provide optional scheduling of pupils and personnel in elementary and secondary schools or residential facilities for children with disabilities.

Repeals Minnesota Statutes 2008, section 123B.05 and Minnesota Statutes 2009 Supplement, section 120A.40.
