Requires retailers to obtain annual licenses from the state fire marshal by January 15 each year for a $1,000 fee, with licenses issued by March 1; prohibits licensure of convicted felons or entities where felons own 5% or more equity.

Establishes facility operation requirements including prohibition of smoking and flame-producing devices, minors only with adult supervision, $2,000,000 liability insurance, 300-foot no-ignition zone, and 50-foot distance from flammable product retailers.

Imposes a public safety fee on 1.4G fireworks retail transactions ranging from $0.00 to $0.04 for purchases under $1.00, or 4% of gross retail income for purchases $1.00 or more; 70% goes to general fund and 30% to fire safety account.

Creates criminal penalties including petty misdemeanor for unauthorized use, misdemeanor for repeat offenses within five years, gross misdemeanor for serious bodily injury, and felony for death or knowing failure to remit public safety fees; appropriates $250,000 in fiscal year 2010 for administration.
