The Pollution Control Agency must draft a proposed rule enabling Minnesota to participate in a regional cap-and-trade system with other Midwestern states, conditional on the federal government not enacting comprehensive greenhouse gas emissions reduction legislation by September 1, 2010.

The proposed rule must be based on the most recent draft model rule published by the Midwestern Greenhouse Gas Reduction Accord Advisory Group.

The Pollution Control Agency must submit the completed proposed rule to legislative committee chairs and ranking minority members with jurisdiction over energy policy and finance, environment policy and finance, and commerce by February 1, 2011.

Any proposed rule must be consistent with Minnesota's greenhouse gas emissions reduction goals under Minnesota Statutes, section 216H.02, subdivision 1.

The section becomes effective the day following final enactment.
