Commissioner shall establish three levels of payment for mental health diagnostic assessment based on three levels of complexity.

Aggregate payment under the tiered rates must not exceed projected aggregate payments under the previous single rate structure, maintaining budget neutrality.

New three-tier rate structure becomes effective January 1, 2011, or upon federal approval, whichever is later.

Maintains existing payment rates for medication management, outpatient mental health services, day treatment services, home-based mental health services, and family community support services at 75.6 percent of the 50th percentile of 1999 charges.

Preserves existing 38 percent rate increase for outpatient mental health services provided by Medicare-certified comprehensive outpatient rehabilitation facilities to nursing facility residents when at least 33 percent of clients are medical assistance recipients.
