Amends Minnesota Statutes section 256B.0625, subdivision 13e, to adjust pharmacy reimbursement rates for medical assistance programs effective July 1, 2009.

Sets base pharmacy dispensing fee at $3.65, with higher fees for compounded intravenous solutions: $8 per bag for standard solutions, $14 for cancer chemotherapy, $30 for one-liter parenteral nutrition, and $44 for larger parenteral nutrition quantities.

Establishes drug cost estimation at average wholesale price minus 15 percent (or minus 30 percent for antihemophilic factor drugs), subject to maximum allowable cost limits comparable to other third-party payers in the state.

Creates special reimbursement provisions for drugs involved in the New England Carpenters Health Benefits Fund v. First Data Bank lawsuit, with dispute resolution through the drug formulary committee.

Authorizes the commissioner to negotiate lower reimbursement rates for specialty pharmacy products (injectable therapies, biotechnology drugs, high-cost treatments) for conditions including multiple sclerosis, HIV/AIDS, hepatitis C, and certain cancers, with discretion to adjust rates to prevent access to care issues.
