Adds new Subdivision 3a establishing that school districts are not required to provide education services to students from other states who lack a disability, lack an individual education plan, and lack a tuition arrangement or agreement to pay for education costs.

Modifies Minnesota Statutes 2008, section 125A.515 regarding placement of students and approval of education programs in residential facilities licensed by the Department of Human Services or Department of Corrections.

Clarifies that the exemption applies only to students without disabilities from out-of-state; students with disabilities or those with tuition agreements remain entitled to services.

Effective July 1, 2010, for fiscal years 2011 and later.
