• Establishes a state regulation system for body art technicians (tattoo and body piercing) and body art establishments, effective January 1, 2011, under Minnesota Statutes chapter 146B.

• Requires body art technicians to be licensed by the Commissioner of Health after completing 200 hours of supervised experience and approved coursework on bloodborne pathogens and infection control.

• Mandates body art establishments be licensed and meet specific health and safety standards including sterilization requirements, proper disposal of contaminated waste, and written aftercare instructions for clients.

• Prohibits tattooing of anyone under 18 regardless of parental consent, and restricts body piercings on minors to cases where a parent or guardian is present and consents (except nipple, genital, branding, scarification, suspension, and tongue bifurcation procedures).

• Sets licensing fees of $100 for technician licenses, $1,000 for establishment licenses, and $75 for temporary establishment permits; appropriates $190,000 for fiscal year 2011 to implement the new regulation system.
