Charter schools may lease space from school boards, intermediate school district boards, or education districts organized under sections 123A.15 to 123A.19.

School boards must first offer unoccupied district buildings to charter schools for lease before offering the space to other entities.

School boards may refuse a charter school's lease offer if it is not competitive in the leasing market.

Charter schools may lease from other nonsectarian organizations if unable to lease from eligible public boards, with Department of Education and Department of Administration approval.

Charter schools may lease from sectarian organizations only if the space is constructed as a school facility and approved by the Department of Education in consultation with the Department of Administration; effective July 1, 2009.
