Requires the prescribing physician to be physically present in the same room when RU-486 (mifepristone) or other abortion-inducing drugs are administered to a patient.

Mandates the physician or their representative make reasonable efforts to schedule a follow-up visit 12 to 18 days after drug administration to confirm pregnancy termination and assess the patient's medical condition, with documentation required in the patient's medical record.

Establishes felony criminal penalties for any person who knowingly or recklessly performs or attempts to perform an abortion in violation of this section; pregnant women cannot be prosecuted.

Allows civil actions for actual and punitive damages by the pregnant woman, the married father of the unborn child, or maternal grandparents against persons who violate the requirement; also permits injunctive relief actions by these parties, health care providers, county attorneys, or the attorney general.

Provides for attorney fees to prevailing plaintiffs, and to prevailing defendants if the court finds the plaintiff's suit was frivolous and brought in bad faith; effective August 1, 2012.
