Changes medical assistance spenddown from "allow" to "require" for persons eligible on a recurring one-month spenddown basis to pay the monthly spenddown amount in advance to the state agency.

Recipients must pay the monthly spenddown amount on or before the 20th of the month to maintain eligibility; failure to pay by this date results in ineligibility for the following month.

Requires local agencies to code the Medicaid Management Information System (MMIS) to indicate recipients are paying the monthly spenddown in advance and updates the Electronic Verification System (EVS) to convey eligibility information to providers.

Effective date is July 1, 2012, or upon any necessary federal approval, whichever is later.

Commissioner must seek any required federal waivers and approvals necessary to implement the changes to the medical assistance spenddown requirements.
