Applicants for initial nursing licensure, licensure by endorsement, or reregistration must submit to state and national criminal history records checks, including FBI records searches.

Applicants must provide notarized consent forms and fingerprints to a board-contracted private vendor and pay no more than $25 for the fingerprinting and records check.

The board shall contract with a private vendor to conduct criminal history records checks and must maintain results as confidential private data, restricting access to board members, officers, investigative staff, and attorneys.

The board may consider 11 factors when reviewing criminal history results, including crime severity, time elapsed since offense, rehabilitation evidence, and whether the crime relates to nursing duties; applicants cannot be licensed without complying with the records check requirement.

If FBI data conflicts with vendor data, the vendor's results supersede the FBI results; applicants may dispute inaccurate results and the board must issue a written decision within 30 working days.
