Removes prohibition on transfers into pooled trusts for persons age 65 or older from Minnesota Statutes section 256B.0595, subdivision 1, paragraph (k).

Adds new exception in subdivision 4, paragraph (e) allowing transfers into pooled trusts established according to section 256B.056, subdivision 3b to be treated as transfers for fair market value.

Changes effective date for pooled trust accounts from January 1, 2014 to January 1, 2011, or when no longer subject to federal maintenance of effort requirements under the Affordable Care Act.

Clarifies that hardship waivers for medical assistance eligibility must consider whether applicants were victims of financial exploitation and whether they took action to prevent the state from being named as remainder beneficiary on annuities.
