HF3004 Summary: Safe Schools for All Students Act

• Requires each school board to adopt a written nondiscrimination policy prohibiting discrimination based on race, color, creed, religion, national origin, sex, marital status, familial status, disability, sexual orientation (including gender identity and expression), public assistance status, age, and association with persons having these characteristics.

• Mandates schools adopt policies prohibiting intimidation, bullying, harassment, and cyberbullying that adversely affect student participation in educational programs or place students in reasonable fear of harm, applying to conduct on school premises, at school-sponsored events, on school transportation, and online communications that substantially disrupt the school environment.

• Requires school policies to include designated administrator oversight, mandatory reporting by staff and trained volunteers, investigation within three days of reports, age-appropriate remedial responses and consequences, protection against retaliation, anonymous reporting options, and annual data collection and analysis.

• Directs the Commissioner of Education to develop a model anti-bullying policy, compile prevention programs, establish a central repository of training materials and resources, conduct biannual compliance reviews, and require teacher preparation programs to include components on preventing intimidation, bullying, harassment, and cyberbullying.

• Applies requirements to charter schools and makes noncompliance with policies grounds for state aid reduction or withholding; repeals existing sections 121A.03, 121A.0695, and 363A.27.
