Restricts grandparent visitation requests in family court proceedings to grandparents who do not have physical custody of the child.

Requires courts to hold a hearing before determining grandparent visitation and to consider whether grandparents have been unreasonably denied prior visitation with the child.

Adds requirement that a child must have resided with grandparents or great-grandparents "without a parent present" for 12 consecutive months before grandparents can petition for visitation rights if the child is removed from their home.

Prevents refiling of denied grandparent visitation motions within six months unless the parties agree in writing.

Repeals subdivision 7 of Minnesota Statutes 2010, section 257C.08.
