School boards must adopt a written policy by January 1, 2012 prohibiting harassment, bullying, intimidation, and violence based on race, color, creed, religion, national origin, sex, marital status, disability, socioeconomic status, sexual orientation, gender identity or expression, age, physical characteristics, or association with a person with these characteristics.

Policies must address harassment, bullying, intimidation, and violence in all forms including electronic and Internet-based conduct, apply to pupils, teachers, administrators, and school personnel, include reporting procedures, and set forth disciplinary actions.

School districts must post policies in school buildings, on district websites, provide copies to employees and contractors, include policies in student handbooks, and develop processes for discussing policies with students and staff.

School employees must receive training on preventing and responding to harassment, bullying, intimidation, and violence, and school districts must establish systems to collect data on such incidents.

Charter schools must comply with the harassment, bullying, intimidation, and violence policy requirements, and Minnesota Statutes 2010, section 121A.0695 is repealed effective January 1, 2012.
