Adds subdivision 3 to Minnesota Statutes section 181.955 to exempt professional athletes from drug and alcohol testing restrictions under sections 181.950 to 181.954.

Allows drug and alcohol testing programs for professional athletes if permitted under a contract between employer and employees.

Requires the exclusive representative of employees and employer to certify to the commissioner of labor and industry that the testing program should operate without interference when requested.

Does not create an exemption from controlled substance crimes under Minnesota Statute chapter 152.

Effective upon governor's signature on May 24, 2011.
