Allows private businesses engaged in mixed municipal solid waste collection services to bring district court action compelling political subdivisions to initiate condemnation proceedings when the government enters the waste collection market.

Applies when a political subdivision provides waste collection services directly or indirectly, or limits the number of private providers so as to exclude an existing private operator from continuing business.

Does not apply to businesses operating under a contract with the political subdivision that sets forth terms and conditions for service provision, or if the subdivision fails to renew or terminates such a contract.

Requires the private business to demonstrate it cannot continue substantially the same waste collection services in substantially the same market as a result of the government's actions.

Establishes a six-month statute of limitations for filing such actions, running from when the political subdivision begins providing the allegedly compensable waste collection services.
