Incumbent electric transmission owners have the right to construct, own, and maintain transmission lines approved in federally registered planning authority transmission plans that connect to their facilities.

For transmission lines connecting to facilities of two or more incumbent owners, each owner holds individual and proportional rights unless they agree otherwise in writing.

Incumbent transmission owners must notify the Public Utilities Commission in writing within 90 days of federal approval if they intend to build the transmission line.

Owners who notify the commission of intent to build must file an application for a certificate of need or certification within 18 months of notice (or longer if approved by the commission).

If an incumbent owner declines to build, the commission may determine whether that owner or another entity will build the line, considering factors such as cost, efficiency, and reliability.
