SF2190 Summary: Data Practices Modifications

• Replaces "person" with "individual" (defined as living human being) throughout Minnesota's data practices statutes to clarify that data classifications apply to natural persons, not organizations or entities.

• Creates new government entity obligations requiring responsible authorities to prepare and maintain data inventories, public access policies, and data subject rights policies that are easily available to the public.

• Expands data access procedures by adding provisions for summary data requests with 30-day response timelines, cost estimates, and nondisclosure agreements to protect not public data used in summary preparations.

• Modifies personnel data classifications to clarify that elected officials (except constitutional officers) are not employees under personnel data rules, and expands disclosure requirements for public officials' complaint and disciplinary information.

• Protects certain sensitive data including inactive financial transaction investigative data and electronic geospatial data shared between government entities at no cost with immunity from civil liability.
