Clay County Board of Commissioners may adopt a resolution to make the county auditor-treasurer position appointive rather than elective, overriding Minnesota Statutes section 382.01.

The county board must publish notice of intent twice weekly for two consecutive weeks and hold a public comment hearing before adopting the resolution, which requires approval from at least 80 percent of board members.

A referendum may be triggered within 60 days of resolution adoption if a petition signed by at least 10 percent of registered county voters is filed; voter approval by majority is required for implementation.

Current elected auditor-treasurer must complete their term or until a vacancy occurs, whichever happens first.

The office may revert to elected status only after at least three years as an appointive position, requiring 60 percent board approval and either board resolution or voter approval through ballot petition process.
