Bill Summary: SF2486

• Modifies licensing moratorium for foster care settings by allowing state-level needs determination process to manage reduction in statewide licensed capacity when recipients move out of non-primary residence settings, effective immediately.

• Establishes new application and annual license fees for home and community-based services providers under chapter 245D, including $585 application fee and $750 annual fee for certain service types, effective July 1, 2012.

• Removes age limitation (previously 16-64 years) for employed persons with disabilities to qualify for medical assistance, and allows assets and income accumulated during prior employment period to carry over for 24 months after turning 65, effective April 1, 2012.

• Expands emergency medical condition coverage for noncitizens to include dialysis services and cancer treatment (surgery, chemotherapy, radiation) for non-remission diagnoses, effective upon final enactment.

• Eliminates 80 percent payment rate reduction for personal care assistants who are relatives of recipients, and reduces provider rate reduction requirements for congregate living settings from ten percent to up to five percent, effective July 1, 2012.

• Appropriates $28,863,000 total ($1,284,000 in FY2012; $27,579,000 in FY2013) for health and human services operations, forecasted programs, and state-operated services including continued operations of Minnesota Specialty Health Services Willmar site through June 30, 2013.
