Commissioner of Education must immediately petition the federal Department of Education for a waiver allowing Minnesota schools to receive No Child Left Behind Act federal funds without federal regulatory restrictions.

Petition must demonstrate Minnesota's history of educational efficacy and explain how funding flexibility will enhance the state education system.

Commissioner must not enforce educational assessment and accountability provisions in Minnesota Statutes chapter 120B related to No Child Left Behind after the 2012-2013 school year.

School boards may file written resolutions with the state auditor recommending how the legislature should reform assessment and accountability provisions without federal mandates.

Commissioner may report proposals and requests to legislative education committees by January 1, 2013.
