Defines food as "produced with" a genetically engineered organism if the source organism was injected or treated with genetic engineering, the animal was fed genetically engineered feed, or the food contains such an ingredient

Exempts food served in restaurants and other establishments for immediate human consumption from labeling requirements

Directs the commissioner to establish methodologies for testing food to determine the presence of genetically engineered organisms

Creates a misdemeanor penalty for violations, effective January 1, 2013
