Director of the State Lottery authorized to adopt rules governing the sale of lottery tickets through electronic scratch ticket devices.

Electronic scratch ticket devices defined as devices displaying electronic facsimiles of lottery scratch tickets with a finite number of tickets and predetermined winning/losing outcomes.

Lottery retailers must have an on-sale intoxicating liquor license under chapter 340A and an organization licensed to conduct lawful gambling on the premises; retailers may operate up to five devices and cannot use "casino" in their names or advertising.

Lottery retailers must transmit 29 percent of their commission from electronic scratch ticket device sales to organizations conducting lawful gambling on the premises.

Electronic scratch ticket devices taxed at two percent on gross receipts instead of regular sales tax rate, and explicitly classified as not "gambling devices" under state law.
