SF747 Summary: Teacher Termination and Discharge Procedures

• Continuing contract teachers can be terminated by board majority roll call vote prior to July 1 (changed from April 1) on grounds specified in subdivisions 9, 10, or 11, or discharged under subdivision 13.

• Teachers proposed for termination must receive written notice of grounds in reasonable detail and may request a board hearing within 14 calendar days; hearing must be granted within ten calendar days before final action is taken.

• For termination under subdivision 9 (inefficiency, neglect of duty, unbecoming conduct, or other good cause), teachers must be given written notice, a written remediation plan, and up to six months to correct deficiencies before contract can be terminated.

• Teachers can elect arbitration instead of board hearing for proposed discharges under subdivision 13; arbitrator selected through striking procedure from bureau of mediation services list, with costs shared equally by both parties.

• Immediate discharge is permitted for immoral conduct, insubordination, felony conviction, conduct requiring immediate classroom removal, failure to teach without release, gross inefficiency after notice, willful neglect, disability after 12-month leave, or inability to terminate at previous school year close.
