Commissioner shall increase payments to long-term care providers by an amount equal to assessable payments they are subject to under the employer shared responsibility requirements of section 1513 of the Affordable Care Act.

Commissioner, in consultation with long-term care providers, shall develop a process and timeline for reporting and verifying assessable payments and increasing provider payment rates.

"Long-term care provider" includes nursing facilities, intermediate care facilities for persons with developmental disabilities, housing with services establishments, and providers of home care, private duty nursing, personal care assistant, and home and community-based waivered services.

Applies to assessable payments related to the Affordable Care Act (Public Law 111-148, as amended by Public Law 111-152) and any amendments, regulations, or guidance issued under those acts.
