Directs the Pollution Control Agency commissioner to amend Minnesota Rules part 7005.0100, subpart 35a, to modify the definition of "potential emissions" or "potential to emit"

Defines potential to emit as the maximum capacity of an emissions unit to emit a pollutant under its physical and operational design while operating at maximum hours of operation

Specifies that fugitive emissions shall not be counted when determining potential to emit, unless required under part 7007.0200, subpart 2, item B

Allows the commissioner to use the good cause exemption under Minnesota Statutes section 14.388, subdivision 1, clause (3), to adopt these rules without following standard rulemaking procedures
