Hennepin County Board of Commissioners may solicit and award design-build contracts using a best value selection process and may utilize design-build procedures available to the Department of Transportation.

Minimum short list for design-build selection reduced from three firms to two firms, but no more than five firms total.

Design-builder must employ or have as a partner a person duly licensed to provide design services; may subcontract services the design-builder is not licensed to perform.

County board may award design-build contracts using one of three methods: best value selection with price/technical score division, alternative process for projects under $5,000,000, or low-bid design-build procedures where scope is clearly defined.

Unsuccessful short-listed proposers receive a stipulated fee of at least 0.2% of the county's estimated design and construction cost; proposers may elect to waive the fee, preventing county use of their proposal ideas.
