School districts, charter schools, and private schools are not obligated to comply with new legislative mandates or regulatory mandates from the Commissioner of Education or Board of Teaching unless the state provides full funding for the mandate in that school year.

Schools may discontinue or modify underfunded mandated activities and must maintain an annual list of discontinued or modified mandates to provide to the Commissioner of Education upon request.

Schools seeking exemption from mandates must petition the Commissioner by February 15 each year, including documentation of implementation costs, estimated state and federal reimbursement, and any cost-prohibitive circumstances; the Commissioner must hold a public hearing and respond by March 15.

The prohibition does not apply to mandates related to revised learning standards, mandates required by federal law, or mandates implementing court-ordered requirements as certified by the Attorney General.

This section becomes effective the day following final enactment.
