Commission cannot allow ratepayers to recover preconstruction costs (planning, design, environmental studies) or regulatory approval costs for nuclear plants begun after July 1, 2010, until the plant operates at 85 percent monthly load capacity factor.

Commission cannot allow ratepayers to recover construction costs exceeding the projected cost, insurance costs exceeding fossil fuel plant equivalents, or local fire protection and emergency service contributions for nuclear plants begun after July 1, 2010.

State tax and fee revenues cannot be used for preconstruction, construction, maintenance, or operating costs of nuclear plants, or to assume financial risk from radioactive releases.

Commission cannot issue a certificate of need for additional spent nuclear fuel storage for plants that have operated for 60 years and receive license extensions.

Utilities must install filtered containment venting systems at Mark I or Mark II nuclear units by December 31, 2014, and the state must report on nuclear emergency planning within a 25-mile radius of plants by January 1, 2014, with costs assessed to the utility owner.
