All smart phones sold or purchased new in Minnesota must include "kill switch" technology that renders devices inoperable in case of theft or loss, effective July 1, 2015.

Kill switch functionality must lock all user data (accessible only to the owner or law enforcement with a warrant), disable the device globally across all wireless networks, prevent reactivation without passcode authorization even after reprogramming or SIM card removal, and be reversible if the device is recovered.

Wireless telecommunications service providers and equipment manufacturers are jointly liable for ensuring compliance and are prohibited from charging consumers additional fees for kill switch functionality.

Service providers offering non-compliant phones must provide theft insurance to consumers at no cost, with insurance form and amount determined by the Commissioner of Commerce and subject to annual approval.
